Privacy policy and processing of personal data

VESPERA AVOCATS (VA) may collect your personal data. VESPERA AVOCATS (VA) declares that it respects the privacy of its Clients and the protection of their personal data. As data controller, VA complies with the regulations in force with regard to the protection of personal data and in particular with the updated French Data Protection law (n°78-17) of 6 January 1978 (hereinafter the “Data Protection law”) and EU Regulation n°2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data.

1. Definitions
Client : any capable natural person or legal entity within the meaning of articles 1123 ff. of the French civil Code, or legal entity, who visits the Site objet of these general conditions.
Content : All the elements constituting the information on the Site, in particular texts – images – videos.
Customer information : All the personal data likely to be held by www.vesperalaw.com through the “Contact us” link.
Benefits and Services : VA is a law firm. 
Site : refers to the site www.vesperalaw.com 
User : Internet user logging on and using the Site.
Personal Information or Personal Data : Information that allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to which it applies  (article 4 of law n° 78-17 of 6 January 1978).
The terms “personal data”, “person concerned”, “subcontractor” and “sensitive data” have the meaning defined by the General Regulations on Data Protection (RGPD : n° 2016-679).

2. Persons responsible for the collection of personal data
For the Personal Data collected in the context of the creation of the User’s personal account and his browsing on the Site, the person responsible for the processing of Personal Data is : Emma Bensoussan-Cremieux.
As the person responsible for processing the data it collects, www.vesperalaw.com undertakes to respect the legal provisions in force. In particular, it is the Client’s responsibility to establish the purposes of its data processing, to provide its prospects and Clients, from the time their consents are collected, with complete information on the processing of their personal data and to show a true image of the processing. Whenever www.vesperalaw.com processes Personal Data, it shall take all reasonable steps to ensure the accuracy and relevance of the Personal Data with respect to the purposes they are processed for.

3. Purpose of the data collected

www.vesperalaw.com is likely to process all or part of the data on the Site in order to process orders and manage its commercial relationships. VA may also use Personal Information for advertising purposes, either with the express consent of the User or within the limits permitted by law. We may also use Client’s data to comply with our legal and/or regulatory obligations. Similarly, to enable browsing on the Site, to prevent and fight against computer fraud (spamming, hacking…) or to improve browsing on the Site.

www.vesperalaw.com does not market Client’s personal data.

4. Right of access, rectification and opposition

In accordance with the European regulations in force, Users have the following rights : 

♣ Right of access (article 15 RGPD) and rectification (article 16 RGPD), updating, completion of Users’ data Right to block or delete Users’ personal data (article 17 RGPD), when they are inaccurate, incomplete, ambiguous, outdated, or the collection, use, communication or storage of which is prohibited
♣ Right to withdraw consent at any time (Article 13-2c RGPD)
♣ Right to limit the processing of Users’ data (Article 18 RGPD)
♣ Right to object to the processing of Users’ data (Article 21 RGPD)
♣ The right to the portability of the data provided by Users, when these data are subject to automated processing based on their consent or on a contract (Article 20 RGPD)

5. Non-disclosure of Personal Data

www.vesperalaw.com shall not process, host or transfer the Information collected about its Clients to a country outside the European Union or recognised as “unsuitable” by the European Commission without informing the Client in advance. www.vesperalaw.com remains free to choose its technical and commercial subcontractors provided that they present sufficient guarantees with regard to the requirements of the General Regulation on Data Protection (RGPD : n° 2016-679). www.vesperalaw.com undertakes to take all necessary precautions to preserve the security of the Information and in particular that it is not communicated to unauthorised persons. However, if an incident affecting the integrity or confidentiality of the Client’s Information is brought to its attention, the Client must be informed of such as soon as possible and informed of the corrective measures taken. www.vesperalaw.com does not collect any “sensitive data”.


6. Cookies

To ensure the proper functioning of the Site, VA may need to record small data files on Users’ equipment. A cookie is a small text file that Websites save on computers or mobile devices during visits. It enables these sites to store actions and preferences (user name, language, font size and other display settings) for a given period of time, so that this information does not have to be re-entered each time a User consults the Site or browses from one page to another.  Cookies can be controlled and/or deleted. 8. Intellectual property rights

All intellectual property rights in relation to this Website and relating to the text, images, logos, photos, drawings or articles remain the property of VA. All photos available on this Website and which are not directly owned by VA have been legally acquired by VA from the owner of the intellectual property rights relating to them. Any information that may be contained on the Site as well as any software to be used in this respect is confidential and protected by the intellectual property laws in force.


10. Disclaimer – Liability

The information available as well as the opinions expressed on www.vesperalaw.com are intended to provide Users with basic and general information and can under no circumstances take the place of legal advice or opinion. This information and opinions accessible via the Site shall not be used, processed or considered as a substitute for personal legal advice, which necessarily responds to the particular factual and legal circumstances of each case.
